David F. Jasinski has a multi-faceted practice concentrating on employment-related litigation, trial and arbitration advocacy, labor negotiation and counseling. Mr. Jasinski provides a unique, practical perspective in guiding employers through the maze of labor and employment issues they face.
Prior to entering the legal profession, Mr. Jasinski was employed as a Manager of Labor Relations for a major North Jersey manufacturing company and was associated with the New Jersey School Boards Association. Prior to starting his own practice, Mr. Jasinski was associated with several prominent labor/employment law firms and headed the Labor/Employment Law Group for a former New Jersey Governor’s law firm. Mr. Jasinski is one of the nation’s “Top 100 Labor Attorneys” as named by The Labor Relations Institute.
Mr. Jasinski represents management in all aspects of labor law, including negotiation of collective bargaining agreements, labor relations, and representation before the National Labor Relations Board and various state labor boards. Additionally, he guides employers through union organizing attempts.
Mr. Jasinski has served as lead counsel in over twenty jury trials defending employers throughout the country. He has extensive experience at trials, hearings, and arbitrations. He litigates in both state and federal courts at all levels including appellate courts. He is a seasoned litigator defending employers in a broad range of employment matters including Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the New Jersey Law Against Discrimination and the New Jersey Conscientious Employee Protection Act. He also represents companies in unfair competition, trade secret, breach of contract and restrictive covenant cases.
Mr. Jasinski has appeared as an expert commentator on MSNBC, Court TV, and ABC’s Good Morning America discussing current labor and employment law issues. Mr. Jasinski is a regular guest lecturer before various employer groups in the tri-state area. He is a member of the Committee on Practice and Procedures before the National Labor Relations Board and has served as an Adjunct Professor at Seton Hall University.
Mr. Jasinski is a member of the New Jersey, New York, and American Bar Associations. He received his A.M. Degree in Labor and Industrial Relations from the University of Illinois and his J.D. Degree from Seton Hall Law School.
Jennifer Chow Van Syckle concentrates her practice in the area of employment law. Ms. Van Syckle joined Jasinski, P.C. after practicing for several years in the labor and employment department of a major New York law firm.
The majority of Ms. Van Syckle’s practice is dedicated to guiding companies in all aspects of employment law. Clients appreciate her practical approach and straightforward advice when tackling difficult matters. She helps employers navigate through a myriad of workplace related issues including leaves of absence, accommodation, terminations, discipline, and layoffs. She has extensive experience in counseling clients on compliance with federal and state employment laws including the Family and Medical Leave Act, the Fair Labor Standards Act, Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the New Jersey Law Against Discrimination, and the New Jersey Conscientious Employee Protection Act.
Ms. Van Syckle focuses on helping employers implement preventative measures to proactively manage risks. This work includes assisting employers of all sizes in numerous industries with new hire documentation and onboarding processes, as well as developing and revising handbooks, manuals, and employer policies. She reviews and prepares a multitude of agreements including employment agreements, independent contractor agreements, separation agreements and non-competition agreements.
Ms. Van Syckle regularly advises clients on wage and hour issues. Her extensive experience has provided her with the knowledge to assist employers in preparing for and successfully resolving governmental wage and hour audits.
Ms. Van Syckle received her B.A. Degree from Manhattan College where she graduated magna cum laude and is a member of Phi Beta Kappa. She earned her J.D. Degree from St. John’s University School of Law where she graduated cum laude and was a member of Law Review. She is one of the founding members of the Asian Student Bar Association at St. John’s.
John C. Hegarty has extensive experience representing municipalities and private employers in both labor and employment. He approaches employer and management issues and concerns from the dual perspective of outside counsel and in-house counsel.
Prior to joining Jasinski, P.C., Mr. Hegarty began his career as a Law Clerk to the Honorable Ernest M. Caposela, J.S.C. and Carmen A. Ferrante, J.S.C. (retired) in Passaic County. Following his clerkship, he began his legal career in one of Passaic County’s sole labor and employment firms, where he gained experience representing private corporations and public entities. Following his relocation to Southern New Jersey, Mr. Hegarty worked in the employment and casino defense department at one of Atlantic County’s largest firms. He then spent several years as in-house Employment/Labor Relations counsel to the City of Atlantic City where he advised the Administration on policy matters and employment decisions, and handled litigation. Mr. Hegarty was instrumental in establishing a Labor/Management Committee in an effort to improve labor relations within the City of Atlantic City and in remodeling the City’s Policy and Procedure Manual.
Throughout his career, Mr. Hegarty has represented corporations, government entities and management in the full gamut of employment issues from initial policy determinations, conducting internal investigations, and throughout the litigation process. He counsels private and public employers on all matters concerning the employer-employee relationship. Mr. Hegarty has represented management, corporations and public entities in all aspects of civil litigation, including employment discrimination, other employment-related litigation and general liability defense. He regularly represents employers before both state and federal courts and administrative agencies.
Mr. Hegarty has extensive experience in collective bargaining negotiations, including successfully negotiating four contracts within a municipality at a zero base increase for two years. He frequently handles administrative law matters, representing management at grievances, arbitrations and appearing before PERC and the NLRB. Additionally, Mr. Hegarty serves as a hearing officer for disciplinary matters.
Mr. Hegarty graduated magna cum laude from Montclair State University receiving the Gang Political Science Award and was a recipient of former United States Senator Bill Bradley’s Outstanding Young Citizen’s Award. He received his J.D. Degree from Rutgers Law School in Newark. He formerly served as Vice President and trustee on the Board of the Stafford Township Education Foundation.
Erin L. Henderson joined Jasinski, P.C. after having worked as a litigation attorney in the New Jersey office of a prominent New York healthcare firm. Ms. Henderson has extensive litigation experience and in her practice, she focuses on the litigation of employment-related claims. She defends New Jersey and New York employers in federal and state court and before administrative agencies including the Equal Employment Opportunity Commission, the New Jersey Division on Civil Rights, the New York State Division of Human Rights, the Department of Labor, and the Workers’ Compensation Board.
Ms. Henderson is experienced with all stages of litigation, from commencement to resolution. She represents management in a wide range of employment related issues, including claims of discrimination, harassment, retaliation, and wrongful termination. She has experience in handling wage and hour class and collective actions and defends misclassification lawsuits. Ms. Henderson’s experience also includes advising clients on the best practices to mitigate risks associated with management decisions and providing counsel with respect to compliance issues.
Ms. Henderson served as a law clerk to the Honorable Ralph L. DeLuccia, Jr. of the Superior Court of New Jersey in Passaic County and was a judicial extern to the Honorable Mary Ann L. Medler, Chief Magistrate Judge of the U.S. District Court for the Eastern District of Missouri. Ms. Henderson earned her J.D. from Washington University in St. Louis.
Mark T. Carlesimo has more than forty four years of diversified general corporate, labor and employment, and transportation legal experience. For the past five years, Mr. Carlesimo has been engaged in private practice representing clients in various industries, including transportation, health care, travel and hotels, entertainment, maritime, car rental, and waste management. From 2006 through 2012, he served as Executive Vice President, General Counsel and Secretary of a publicly traded corporation, Velocity Express. In this role, Mr. Carlesimo managed the entire legal department, including mergers and acquisitions, state and federal DOT, SEC and other regulatory compliance in over forty states, corporate governance and finance, litigation management, labor and employment, real estate, software licensing, and franchising. Mr. Carlesimo also supervised all aspects of the human resources, including preparation and implementation of employee benefits policies, employment manuals, incentive compensation plans, executive employment and separation agreements, and non-competition and confidentiality agreements.
From 1997 until its merger with Velocity in 2006, Mr. Carlesimo served as Senior Vice President, General Counsel and Secretary of CD&L, Inc., a $250 million dollar publicly traded package delivery company where he performed similar functions. Prior to CD&L, Mr. Carlesimo served for fifteen years as Vice President and Assistant General Counsel of Cunard Line Limited, a wholly-owned subsidiary of London based conglomerate, Trafalgar House, PLC. During his tenure, Cunard acquired and operated passenger cruise ships, hotels and resorts on a world-wide basis, and grew from £100 million to £550 million in revenue. Earlier in his career, Mr. Carlesimo served as Staff Counsel to the Atlantic Container Division of Seatrain Lines, Inc., a $1.5 billion NYSE conglomerate with operations that included ocean container shipping, domestic oil refineries and U.S. flag shipbuilding.
Mr. Carlesimo received a B.A. in Economics from Fordham University and received his J.D. from Fordham University School of Law. Mr. Carlesimo is a member of the New York and New Jersey bars.
Taylor Lopa is an associate attorney at Jasinski, P.C., where she represents clients in all areas of employment law. She is committed to achieving positive outcomes for clients and works closely with businesses to address the employment issues they are facing.
Prior to joining Jasinski, P.C., Ms. Lopa began her legal career in New York City as an Assistant District Attorney in the Richmond County District Attorney’s Office. In that capacity, Ms. Lopa handled hundreds of criminal cases, conducted court appearances and hearings, and engaged in motion practice regarding complex areas of law.
Ms. Lopa received her undergraduate Degree from the University of Delaware, where she studied Criminal Justice and obtained minor degrees in Legal Studies and Spanish. Afterwards, Ms. Lopa received her J.D. from St. John’s University School of Law, where served as a member of the Law Review and graduated magna cum laude.
